DECREE NO. 5,157, DECLARING A STATE OF ECONOMIC EMERGENCY IN THE NATIONAL TERRITORY

On August 8, 2025, Decree No. 5,157 was published in the Official Gazette [E] 6,924, through which the National Executive declares a State of Economic Emergency in the national territory.

A state of Economic Emergency is established throughout the country due to exceptional circumstances that significantly affect the national economy. This measure is intended to allow the National Executive to implement urgent, extraordinary and necessary actions to maintain economic stability and ensure that citizens can fully exercise their rights.

Consequently, the legal reserve in economic, financial and monetary matters is suspended for the duration of the economic emergency. As a result of this declaration, the President of the Republic is authorized to take all decisions he deems pertinent to promote the development and economic growth of the country. Among these decisions, the following stand out:

  • Suspend, in general, the application and collection of national, state and municipal taxes.
  • To concentrate on the National Treasury the collection of the special fees and contributions created by laws and to redirect the available resources from all existing funds.
  • Establish extraordinary mechanisms to combat tax evasion and avoidance.
  • Suspend the application of national tax exemptions and proceed to collect them.
  • To issue exceptional and transitory regulations that are necessary to restore economic balances and protect the rights of the population.
  • Establish mechanisms and percentages for the compulsory purchase of national production, to favor import substitution.
  • Adopt the necessary measures to stimulate national and foreign investment for the benefit of the development of the productive apparatus, as well as exports of non-traditional items, as a mechanism for the generation of new sources of employment, foreign exchange and income.
  • To authorize the contracts that may be necessary to guarantee the restoration of the population’s fundamental rights.

This Decree will have a duration of 60 days, counted from its publication in the Official Gazette, extendable for 60 more days.

Finally, the Decree will enter into force as of its publication in the Official Gazette of the Bolivarian Republic of Venezuela
