This LEĜA Perspectives aims to summarize the most important aspects of the regulatory environment of private enterprise in Venezuela, during February 2026.
I. Decisions of the Constitutional Chamber
On February 10, 2026, judgment No. 0003 of the Constitutional Chamber of the Supreme Court of Justice was published, declaring the constitutionality of Decree No. 5,242, of February 8, 2026, issued by the President (E), by which it extends for sixty (60) days the validity of Decree No. 5,190 by which the State of Economic Emergency was declared throughout the National Territory.

1. Amnesty Law for Democratic Coexistence
In the extraordinary Official Gazette No. 6,990 of February 19, 2026, the Amnesty Law for Democratic Coexistence was published.
- Law on Partial Reform of the Law on the Statute of the Function of the Investigative Police
In the extraordinary Official Gazette No. 6,980 of February 5, 2026, the Law of Partial Reform of the Law on the Statute of the Function of the Investigative Police was published.
III. Appointments
- Attorney General
In the Official Gazette No. 43,323 of February 25, 2026, the Agreement of the National Assembly was published by which Larry Daniel Devoe Márquez is appointed as Attorney General of the Republic, as person in charge.
- Minister of People’s Power for Tourism
In the extraordinary Official Gazette No. 6,979 of February 2, 2026, Decree No. 5,237 was published, appointing the citizen Daniella Desireé Cabello Contreras, as Minister of People’s Power for Tourism, in the capacity of person in charge.
- Vice-Ministries in the Ministry of People’s Power of the Office of the Presidency and Monitoring of Government Management
In the extraordinary Official Gazette No. 6,984 of February 9, 2026, Decree No. 5,246 was published, appointing José Gregorio Machado Pérez as Deputy Minister of Presidential Support, Alejandra Carolina Bastidas González as Deputy Minister of Presidential Communication, Jairo Ernesto García Briceño, as Vice Minister of Presidential Activities, Luis Alfredo Motta Domínguez as Deputy Minister of Government Management Monitoring and José Gregorio Mendoza Rodríguez. as Deputy Minister for Social Protection.
- Reorganization of the operation of the Ministry of People’s Power for the Office of the Presidency and Monitoring of Government Management and its attached entities
In the extraordinary Official Gazette No. 6,985 of February 9, 2026, Decree No. 5,248 was published, through which it aims to reorganize the operation of the Ministry of People’s Power for the Office of the Presidency and Monitoring of Government Management and its attached entities.
- Sectoral Vice-President for Communication and Culture
In the extraordinary Official Gazette No. 6,981 of February 6, 2026, Decree No. 5,241 was published, appointing Miguel Ángel Pérez Pirela as Sectoral Vice President of Communication and Culture.
- Appointments in the electricity sector
The following appointments in the electricity sector were published in Official Gazette No. 43,320 of February 20, 2026:
Resolution No. 007, appointing Gloria Amarilys Bracho Naveda, as General Director of Electricity Service Planning, attached to the Vice Ministry of Electric Service, of the Ministry of People’s Power for Electric Energy, as Person in Charge.
Resolution No. 008, appointing Domingo Roberto González, as Director General of Strategic Projects for Investment, attached to the Vice Ministry of Electric Service, of the Ministry of People’s Power for Electric Energy, as Person in Charge.
Resolution No. 013, appointing María Gabriela Ruíz Flores, as Director General of Ecosocialist Electrical Culture, as Head, attached to the Vice Ministry of Alternative Sources and Popular Participation, of the Ministry of People’s Power for Electric Energy.
Resolution No. 014, appointing Edison Edgardo Mayorga Zábala, as General Director of Eco-energy Management and Community Articulation, as Head, attached to the Vice Ministry of Alternative Sources and Popular Participation, of the Ministry of People’s Power for Electric Energy.
Resolution No. 015, appointing Ramón Gilberto Quintero Torres, as Director General of Alternative Sources, as Head, attached to the Vice Ministry of Alternative Sources and Popular Participation, of the Ministry of People’s Power for Electric Energy.
- Creation of vice-ministries of the Ministry of People’s Power of Industries and National Trade
Decree No. 5,253 was published in Official Gazette No. 43,322 of February 24, 2026, creating the Offices of the Vice Minister of Industrial and Commercial Development, Industrial and Commercial Regulation and Industrial and Commercial Management of the Ministry of People’s Power of Industries and National Commerce.
By means of Decree No. 5,254, Hendrick Perdomo Colmenares, María Fernandea Palencia and Peggy Silva Rojas, respectively, were appointed as deputy ministers of these vice-ministries.
- General Director of the Legal Consultancy of the Ministry of People’s Power of Economy and Finance
In the Official Gazette No. 43,319 of February 19, 2026, Resolution No. 001-2026 was published, appointing Anmy Ivonett Pérez González, as General Director of the Legal Consultancy of the Ministry of People’s Power of Economy and Finance, as head of the Ministry.
- Positions in the Ministry of People’s Power for Foreign Trade
In the extraordinary Official Gazette No. 6,984 of February 9, 2026, Decree No. 5,245 was published, appointing Andreína Tarazón Bolívar as Deputy Minister of International Trade Policy, Johann Carlos Álvarez Márquez as Deputy Minister of Export Promotion, Coromoto Godoy Calderón as President of the Export Promotion Agency S.A., in charge and Andreína Tarazón Bolívar as president of the Country Brand Institute Foundation, in the capacity of manager.
- SUDEBAN Superintendent
In the Official Gazette No. 43,314 of February 10, 2026, Decree No. 5,250 was published, appointing Anmy Ivonett Pérez González, as Superintendent of the Banking Sector Institutions (SUDEBAN), attached to the Ministry of People’s Power of Economy and Finance.
- Appointments at the International Centre for Productive Investment
The following appointments were published in the Official Gazette No. 43,324 of February 26, 2026, at the International Center for Productive Investment:
Ruling No. 001-2026, appointing Alcides Alejandro Robles Gordillo, as General Manager of Investment Projects and Assets, as head of the International Center for Productive Investment.
Ruling No. 002-2026, appointing Marco Antonio Magallanes Grillet, as Legal Consultant, as head of the International Center for Productive Investment.
- General Director of Legal Consulting of the Ministry of People’s Power for Health
In the Official Gazette No. 43,316 of February 12, 2026, Resolution No. 062 was published, appointing Sergio Rafael Rodríguez Figuera, as General Director of Legal Consulting, of the Ministry of People’s Power for Health.
- President of the National Institute of Hygiene “RAFAEL RANGEL”
In the Official Gazette No. 43,308 of February 2, 2026, Decree No. 5,238 was published, appointing Luisana Melo Solórzano as President of the National Institute of Hygiene “RAFAEL RANGEL”, who in turn will be the President of the Board of Directors of the aforementioned Institute.
- Commission for the Disincorporation of Public Assets and CANTV Tenders Committee
In the Official Gazette No. 43,309 of February 3, 2026, the Act of fifteen (15) of October 2025 was published, through which the Members of the Commission for the Disincorporation of Public Assets and the Bidding Committee for the Sale and Exchange of Public Goods of CANTV are appointed. In accordance with the first article of that Act, it was resolved to appoint the members of the Commission for the Disincorporation of Public Assets and the Bidding Committee for the Sale and Exchange of Public Assets of CANTV for the purpose of evaluating, recommending and processing the disposal of CANTV’s public assets.
